CEO Instruction: Entry Restrictions No. 1.1 to an Education Facility COVID-19 Vaccination Requirement

1. Content


1. Context

1.1 The Director General of Education has authority, pursuant to Section 233 of the School Education Act 1999 and the Public Sector Management Act 1994, to issue an instruction to any employee performing a function in the Department.

1.2 On 22 December 2021, the Chief Health Officer signed the 'Education Worker (Restrictions on Access) Directions (No. 4)' (Education Worker Directions). A copy of the Education Worker Directions is available on the WA Government website, www.wa.gov.au.

1.3 The Education Worker Directions restrict an Education Worker from entering an Education Facility, which includes a School, Boarding Premise, Community Kindergarten or Statewide Services Padbury, unless the Education Worker has been vaccinated in accordance with the Education Worker Directions. A term used in this Instruction has the same meaning that it has in the Education Worker Directions.

1.4 On 7 January 2022, the Chief Health Officer issued the 'Booster Vaccination (Restrictions on Access) Directions (No. 2)' (Booster Directions). The Booster Directions specify the booster vaccination requirements applicable to Education Workers entering an Education Facility. A copy of the Booster Directions is available on the WA Government website, www.wa.gov.au.

1.5 This Instruction, 'CEO Instruction Entry Restrictions No. 1.1 to an Education Facility COVID-19 Vaccination Requirement', is in addition to 'CEO Instruction Entry Restrictions No. 1' dated 9 December 2021 and provides for the Booster Direction.

1.6 This Instruction is issued to operationalise within the Department the Education Worker Directions in conjunction with the Booster Directions. This Instruction applies to employees of the Department that are considered an Education Worker on the following basis (Worker), being an employee who:

    a. Is a staff member of an Education Facility (on a permanent, temporary or casual/relief basis); or

    b. attends an Education Facility other than on an ad hoc basis. Ad hoc basis means attendance at any Education Facility or Facilities no more than once a week.

1.7 This Instruction does not apply to those who are not employed by the Department. The management of non-employee Education Worker entry to an Education Facility is addressed through a separate CEO Instruction that does not apply to students or employees of the Department.


2. Instruction to Workers

2.1 A Worker must:

    a. meet the Vaccination Requirement specified in Paragraph 3;

    b. have Approved Evidence of the Vaccination Requirement specified in Paragraph 4;

    c. have a Vaccination Record in accordance with Paragraph 5; and

    d. not enter an Education Facility unless they have met the Vaccination Requirement and have a Vaccination Record of such.


3. Vaccination Requirement

3.1 A Worker must have:

    a. had the first dose of the COVID-19 vaccine by 12.01 am on 1 January 2022 (First Vaccination);

    b. a second dose of the COVID-19 vaccine by 12.01 am on 31 January 2022 (Second  Vaccination);

    c. a booster dose of the COVID-19 vaccine (Booster Vaccination) within one calendar month of the date the person first became eligible, or by 5 February 2022, whichever is latest (Booster Vaccination Date); or

    d. an exemption from a First, Second or Third Vaccination (Exemption).


4. Approved Evidence

4.1 The Chief Health Officer has approved that the evidence of the Vaccination Requirement may take the following forms (Approved Evidence);

    a. documentary confirmation of COVID-19 vaccination(s) or exemption given by the Department of Health;

    b. a COVID-19 digital vaccination certificate or Australian Immunisation Register Immunisation History Statement; or

    c. an international COVID-19 vaccination certificate issued by the Australian Government.


5. Record of Approved Evidence

5.1 A Worker must have a record of the Approved Evidence of the Vaccination Requirement in the Human Resource Management Information System (Vaccination Record) showing:

    a. the First and Second Vaccination; and

    b. the Booster Vaccination as soon as possible after having received the Booster Vaccination; or

    c. an Exemption.


6. No Entry to an Education Facility

6.1 A Worker must not enter an Education Facility unless they have met the Vaccination Requirement and have a Vaccination Record of such.


7. Failure to Comply and Fulfil Duties

7.1 A Worker who is required to attend an Education Facility to fulfil their duties and cannot because they have not met the Vaccination Requirement or do not have a Vaccination Record will be stood down without pay and may be subject to a disciplinary process, which may result in termination of employment.
