CEO Instruction: eRideables and eBikes on school premises

Mandated for all government schools

1. Context

1.1 The Director General of Education has authority, pursuant to section 233 of the School Education Act 1999 (SE Act) to issue instructions to persons performing functions in the Department of Education.

1.2 Section 61 of the SE Act provides that the Director General is responsible for determining, implementing and monitoring the standard of care to students in government schools.

1.3 Section 63 of the SE Act provides that principals are responsible for:

a) day-to-day management and control of the school, including all persons on the school premises – section 63(1)(b) and

b) ensuring the safety and welfare of students on school premises so far as that can reasonably be done – section 63(1)(c)(i).

1.4 Regulation 70 of the School Education Regulations 2000 (Regulations) provides that a principal may, by order, prohibit an item from being brought on to school premises:

a) the order must be publicly displayed on the school premises Regulation 70(3).

1.5 Regulation 228 of the Road Traffic Code 2000 (Code) prohibits a person under the age of 16 from operating:

a) an electronic rideable device (eRideable) with the motor(s) engaged or

b) a power assisted pedal cycle (eBike) with the power assistance engaged.

1.6 The Road Traffic (Authorisation to Drive) Regulations 2014 (Vehicle Authorisations) set age limits for cars and motorbikes as 17 and mopeds as 16 provided other requirements have been satisfied.

1.7 For students aged 16 and over, the decision to allow storage and/or charging of eRideable or eBike devices on school sites is at the discretion of principals.

2. CEO Instruction to principals

2.1 This CEO Instruction commences on 2 February 2026.

2.2 Principals must ensure that students under the age of 16 are not permitted to use or store an eRideable or eBike on school premises.

3.2 Examples of eRideables include, but is not limited to:

  • eScooters
  • eSkateboards
  • hoverboards
  • eSkates
  • eUnicycles.
